• Title IX was never designed to address the allegations of sexual misconduct. It is not an appropriate statutory framework.
• President Biden cannot simply issue an Executive Order and instruct the Department of Education to tell all the Title IX offices across the country to not follow properly implemented regulations from the previous administration. It is a violation of the separation of powers and the Administrative Procedures Act.
• NCLA sued Cornell University for its violations of due process, but also the Department of Education for forcing Cornell to adopt such an unfair process in the case Mukund Vengalattore v. Cornell University and U.S. Dept. of Education.
