It’s a scary time to be on campus and not just because of COVID-19. In the past decade, the US Department of Education has prioritized the detailed management of disciplinary actions on campus for students and faculty accused of sexual misconduct. The department has been intimidating schools into adopting specific types of disciplinary action, under threat of losing its significant federal funding. The overriding theme of the department was that schools should make these “kangaroo court-like” procedures fundamentally unfair to defendants.
