Reed D. Rubinstein
Senior Litigation Counsel
Reed D. Rubinstein is a Senior Litigation Counsel handling trials and appeals of constitutional, Administrative Procedure Act, and other cases. He has extensive experience in the law and practice of Executive Branch and Congressional oversight and investigations.
Mr. Rubinstein spent thirty years in the private practice of law defending government investigations and enforcement proceedings and obtaining redress for abusive or unlawful administrative agency and political conduct. Among his notable representations were the victims of the Fort Hood terrorist attack in their action against the Department of the Army and the FBI for negligence, constitutional violations, and the unlawful denial of Purple Hearts and medical benefits, and LabMD, Inc. in its statutory and constitutional defense against an unlawful FTC enforcement action. He was a recognized advocate for administrative law reform, testifying to Congress on the need to roll back regulatory overcriminalization.
Mr. Rubinstein joined the Trump Administration in January 2017, serving as Deputy Associate Attorney General, General Counsel of the U.S. Department of Education (delegated), and Senior Advisor to the Secretary of the Treasury, among other things. His work included civil rights litigation, investigations, and regulatory action; investigating and exposing Communist Chinese Party funding of U.S. higher education; managing high priority litigation and regulatory matters; and strengthening Iran sanctions. Between June 2019 and January 2021, he initiated and led 27 civil investigations of U.S. universities for violating foreign money disclosure requirements, consumer protection laws, and grant conditions, including an investigation of Princeton University for violation of its nondiscrimination assurances.
He led or played a material role in many regulatory and Executive actions and orders, including Dep’t of Educ., Guidance Regarding Department of Education Grants and Executive Order 13798; Dep’t of Educ., Nondiscrimination on the Basis of Sex in Education Programs or Activities Receiving Federal Financial Assistance; Executive Order 13899, Combatting Anti-Semitism; Executive Order 13892, Promoting the Rule of Law Through Transparency and Fairness in Civil Administrative Enforcement and Adjudication. Also, he defended Executive Branch agencies against overreaching Congressional oversight and provided Cabinet Secretaries and White House officials with advice and counsel on matters of political significance and risk.
Mr. Rubinstein earned his JD, MA, and AB degrees from the University of Michigan. He is a member of the District of Columbia, Virginia, Michigan, and Connecticut bars.
