In the Matter of Rev. Father Emmanuel Lemelson

NCLA asked SEC to dismiss its administrative enforcement proceeding against the Reverend Father Emmanuel Lemelson, a Greek Orthodox priest and activist investor. The proceeding was  irreparably tainted by the filing of an unauthorized, ultra vires federal lawsuit purportedly filed on behalf of SEC without the Commissioners’ authorization, along with an SEC internal control failure that further tainted the proceeding. These irregularitie negated any plausible appearance that the Commission could fairly and impartially adjudicate its related administrative enforcement prosecution against him.

SEC dismissed the ultra vires lawsuit in May 2025 and the administrative enforcement proceeding in September 2025, important victories for Fr. Lemelson and NCLA.
