TWISM Enterprises v. State Board of Registration for Professional Engineers and Surveyors

NCLA argued that the Hamilton County Court of Appeals erred by deferring to the Ohio Board of Registration for Professional Engineers and Surveyors’ “reasonable interpretation” of what the court characterized as “ambiguous statutes and administrative rules.” Agency deference violated the Ohio Constitution and violates the federal Constitution by requiring judges to abandon their duty of independent judgment.
