The Relentless and Loper Bright cases are landmark victories, Chevron has been described by The Wall Street Journal as “arguably the most significant decision of the year.” This landmark decision marks the end of a 40-year era of ‘judicial deference,’ where judges blindly accepted agency interpretations of the law. Such practices undermined due process and compromised judicial independence. No case better embodies the unfairness of Chevron deference than Relentless. This decision reins in unimpeded regulatory power from the Administrative State that has degraded a free society and threatened liberty.
